Criminal Law

(Summary Offences and Hybrid Offences Proceeding by ​Summa​ry Conviction)


A summary conviction offence is the least serious kind of criminal offence under ​Canada's Criminal Code. They have a maximum penalty of 6 months or less of ​imprisonment and a fine of up to $5000.



Some Summary convictions include but are not limited too;


  • s. 89(2) – Carrying weapon while attending public meeting
  • s. 177 – Trespassing at night
  • s. 517(2) – Failure to comply with order (Order directing matters not to be ​published for specified period)
  • s. 539(3) – Failure to comply with order (Order restricting publication of ​evidence taken at preliminary inquiry)
  • s. 672.501(11) – Failure to comply (Order restricting publication – sexual ​offences, NCR)


Some Hybrid offences that may be convicted by Summary Conviction


  • s. 88(2) – Possession of weapon for dangerous purpose
  • s. 90(2) – Carrying concealed weapon
  • s. 104(2) – Unauthorized importing or exporting (firearm /weapon)
  • s. 121.1(4)(b) – Selling, etc, of tobacco products and raw leaf tobacco
  • s. 127(1) – Disobeying order of court

Pr​ovincial Offence Court

T​h​e Ontario Court of Justice hears provincial offences cases.


  • Examples of these cases include:Highway Traffic Act charges such as ​speeding;
  • Municipal by-law charges which include excessive noise, animal control; and
  • Charges laid under provincial legislation such as the Environmental Protection ​Act, Occupational Health and Safety Act, Dog Owners’ Liability Act and the ​Trespass to Property Act.


H​uman Rights Tribunal

Human Rights Tribunal of Ontario hears and resolves claims of discrimin​ation and harassment brought under the Human Ri​ghts Code

In Canada, our Human RIghts are protected by the Charter of Rights and Freedom ​under both the federal and provincial government bodies. This includes ​municipals, and Employer.


A few examples that are stated in the Charter are as following;




  • the right to:
    • life, liberty and personal security
    • a fair trial, that respects all your legal rights
    • be presumed innocent until you’re proven guilty
    • talk to a lawyer as soon as possible if you are arrested
    • equal protection and benefit under the law, without discrimination
  • freedom of:
    • conscience and religion
    • thought, belief, opinion and expression
    • the press and other media
  • freedom to:
    • join groups
    • hold peaceful meetings
  • protection from:
    • unreasonable search or seizure
    • being detained or put in prison without a just reason
